Terms of Service

1. What foom Trade Provides

foom Trade is a cryptocurrency trading application. Depending on the version of the app and what the interface actually enables for you, you may be able to create an account, use an in-app wallet, view live market data, deposit and withdraw digital assets, and place trades.

Features that are hidden, disabled, or labeled as unavailable are not offered. Marketing pages, these Terms, and third-party descriptions are not a promise that every foom surface is live in your copy of the app.

2. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. You may not use the Services where doing so would violate applicable law, including sanctions or local restrictions on digital-asset activity.

3. Accounts, Wallets, and Trading

Some versions of the Services require an account. Where Sign in with Apple or another supported sign-in method is offered, you must keep that account secure and under your control.

An in-app wallet, if shown, lets you hold and move digital assets you control. IU LLC does not take custody of your private keys unless a specific product surface says otherwise. On-chain transactions are irreversible once confirmed. You are responsible for destination addresses, network selection, and gas or network fees.

When you deposit USDC on another network (Base, Arbitrum or Ethereum), or USDG on Robinhood Chain, foom automatically moves it into your cash balance as USDC, up to $1,000 per transfer. foom can only send it to your own cash wallet. The network fee for the move (usually a few cents) and, for USDG, the conversion to USDC are shown on the receipt and come out of the amount moved. You can turn this off anytime in Settings.

Trades, deposits, and withdrawals that the app enables are executed through third-party protocols, routers, venues, or on-ramps. Availability, pricing, liquidity, and settlement times are not guaranteed. A quoted price is not a filled trade.

4. Not Financial Advice; Risk of Loss

foom Trade is not a bank, broker-dealer, exchange, custodian, or investment, legal, tax, or accounting adviser. Nothing in the Services is an offer, solicitation, recommendation, or promise of any result.

Digital assets are volatile. You can lose some or all of the value you put at risk, including to market moves, smart-contract failure, protocol outages, user error, or third-party failure. You are solely responsible for your decisions.

5. Acceptable Use

You may use the Services only for lawful purposes. You may not:

• interfere with, disrupt, or attempt unauthorized access to the Services;
• use automated means to scrape or overload the Services except as permitted by us in writing;
• reverse engineer or bypass security or access controls except where applicable law expressly permits it;
• use the Services to violate law, sanctions, or another person's rights;
• misrepresent foom Trade content as individualized advice, a guaranteed outcome, or a feature the app does not actually offer; or
• attempt to reverse, recall, or charge back an on-chain transfer that has already been broadcast.

We have zero tolerance for objectionable content and abusive behaviour. Content that breaks our Community Guidelines is removed, and the account responsible may be taken off public lists or terminated. Report it from the thesis, comment or profile, and contact us from the Support page.

6. Fees

foom may charge a trading or service fee on activity the app enables. Network fees, venue fees, and third-party on-ramp or bridge fees are separate and are paid to those providers. Fee amounts shown in the app at the time of the action control over marketing copy.

7. Intellectual Property

The Services, including their software, design, text, graphics, trademarks, and other content, are owned by IU LLC or its licensors and protected by applicable intellectual-property laws.

Subject to these Terms, IU LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services. No other rights are granted.

8. Third-Party Services

The Services rely on third parties for identity, wallet infrastructure, market data, routing, settlement, on-ramps, hosting, and similar functions. IU LLC does not control those providers and is not responsible for their availability, accuracy, security, content, or practices. Your use of a third-party service is also governed by that provider's terms.

9. Apple App Store Terms

If you download foom Trade through Apple's App Store, these Terms are between you and IU LLC, not Apple. Apple is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions applicable to them.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." IU LLC DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

IU LLC does not warrant that market data is current, complete, or error-free, that a trade will fill, or that wallets, protocols, or third-party services will remain available.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IU LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, DIGITAL ASSETS, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICES.

Where liability cannot be excluded, IU LLC's aggregate liability arising from or related to the Services will not exceed the greater of the amount you paid IU LLC for the Services during the twelve months before the event giving rise to the claim or US$100. Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you.

12. Suspension and Termination

You may stop using the Services at any time. We may suspend or discontinue all or part of the Services when reasonably necessary for security, legal compliance, maintenance, or product changes. Provisions that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by applicable law, without regard to conflict-of-law principles. Before filing a claim, you agree to contact legal@foomfamily.ai (or legal@foom.trade, which remains monitored during the domain transition) and attempt in good faith to resolve the dispute informally. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.

14. Changes to These Terms

We may update these Terms as the Services or legal requirements change. We will post the revised Terms with a new "Last updated" date. Material changes apply prospectively, and continued use after they take effect constitutes acceptance where permitted by law.

15. General

These Terms and the Privacy Policy constitute the agreement between you and IU LLC concerning the Services. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or transfer of the Services.
