FOOM Trade — Terms of Service

1. What FOOM Trade Provides

FOOM Trade provides an informational market guide explaining selected market concepts and signals.

The current iOS app does not provide live market data, create accounts, connect wallets, execute trades, move money, or custody assets. Content may be incomplete, delayed, or inaccurate and should not be treated as a live quote or execution instruction.

2. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. You may not use the Services where doing so would violate applicable law.

3. Informational Use Only

FOOM Trade content is provided for general informational and educational purposes. It is not financial, investment, legal, tax, or accounting advice; a recommendation; an offer or solicitation; or a promise of any result.

You are solely responsible for your decisions. Before acting on financial information, independently verify it and consult a qualified professional where appropriate.

4. Acceptable Use

You may use the Services only for lawful, personal purposes. You may not:

• interfere with, disrupt, or attempt unauthorized access to the Services;
• use automated means to scrape or overload the Services except as permitted by us in writing;
• reverse engineer or bypass security or access controls except where applicable law expressly permits it;
• use the Services to violate law or another person's rights; or
• misrepresent FOOM Trade content as live data, individualized advice, or a guaranteed outcome.

5. Intellectual Property

The Services, including their software, design, text, graphics, trademarks, and other content, are owned by FOOM or its licensors and protected by applicable intellectual-property laws.

Subject to these Terms, FOOM grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services. No other rights are granted.

6. Third-Party Services and Links

The Services may reference or link to third-party websites, market sources, or services. FOOM does not control or endorse them and is not responsible for their availability, accuracy, security, content, or practices. Your use of third-party services is governed by their terms.

7. Apple App Store Terms

If you download FOOM Trade through Apple's App Store, these Terms are between you and FOOM, not Apple. Apple is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions applicable to them.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." FOOM DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

FOOM does not warrant that content is current, complete, error-free, or suitable for any particular decision.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICES.

Where liability cannot be excluded, FOOM's aggregate liability arising from or related to the Services will not exceed the greater of the amount you paid FOOM for the Services during the twelve months before the event giving rise to the claim or US$100. Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you.

10. Suspension and Termination

You may stop using the Services at any time. We may suspend or discontinue all or part of the Services when reasonably necessary for security, legal compliance, maintenance, or product changes. Provisions that by their nature should survive termination will survive.

11. Governing Law and Disputes

These Terms are governed by applicable law, without regard to conflict-of-law principles. Before filing a claim, you agree to contact legal@foom.trade and attempt in good faith to resolve the dispute informally. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.

12. Changes to These Terms

We may update these Terms as the Services or legal requirements change. We will post the revised Terms with a new "Last updated" date. Material changes apply prospectively, and continued use after they take effect constitutes acceptance where permitted by law.

13. General

These Terms and the Privacy Policy constitute the agreement between you and FOOM concerning the Services. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or transfer of the Services.
